Guidelines on the processing of your personal data, under art. 13 of Legislative Decree. No. 196/2003 on the protection of personal data
Under Legislative Decree No. 30.06.03. 196 (“Statute on the protection of personal data) we inform you that your “personal data”, whether received virtually through the website, either directly or through third parties, will be processed and inserted in databases. This process is essential for the proper execution of our ongoing contractual relationship. The legislation in question provides, first, that whoever performs the processing of personal data is required to inform the person concerned regarding the data processed and sometimes the process itself, which in any case must be carried out with fairness and transparency, protecting your privacy and your rights. Under article 13 of Legislative Decree. No.196/2003, therefore, please note that:
Type of data processed
All data provided by you, including data of a business nature, will be used for the following purposes: - To provide the expected services; - For requirements needed to set up the contracts; - For the development of contractual relationships and the consequent fulfilment of legal and tax-related duties as well as to enable the effective management of financial and commercial dealings. This includes, for example, billing; - To carry out activities directly related and instrumental to the provision of contractual services; - To check the progress of business relations with customers; - To carry out market research, marketing statistics and product preferences. - We are not in possession of any data classified as sensitive or of a judicial nature in accordance with art. 4, paragraph 1, of Legislative Decree. No. 196/2003.
Data Processing Purposes
The data will be processed for the entire duration of the contract and, thereafter, for the fulfilment of legal duties and for administrative and commercial purposes. The data processed by automated tools will, however, be deleted at the end of the contract.
Data Processing Method
The data will be processed mainly through electronic and computer media and stored on computer media, on paper or on any other suitable media, in compliance with minimum safety measures under the Technical Regulations on minimum safety measures, Annex B of Legislative Decree. No.196/2003.
Duty or right to provide the data and penalties for noncompliance
With regard to the data that we need to be familiar with to fulfil the duties required by laws, rules and EC legislation, or provisions issued by authorities empowered by law and regulated by surveillance and control entities, noncompliance on your part will prevent the start and the development of the transaction, to the extent that such data are required for it. With regard to the data we are not required to know, we will evaluate the missing data from time to time. This will determine the resulting decisions. Said decisions will be taken, proportionally to the importance of the data required by us but not submitted by you.
Communication and distribution
Your details will not be “disclosed” by us to unclassified subjects in any way, even though the data are being made available for consultation.
The following may be granted access to your data:
- Domestic and foreign companies only for purposes related to the contractual relationship with you;
- Our employees as managers or, especially, the employees of the technical department; accounting office, operations office or sales office;
- Parties who can access your data based on the provisions of the law, regulations, or EC legislation, within the limits set by these rules;
- Parties, our consultants, who need access to your personal details for purposes related to our business relationship, to the extent strictly necessary to perform the tasks assigned to them (e.g. credit institutions);
- Parties, our consultants, to the extent necessary to carry out their duties in our Company, subject to our letter of appointment clearly stating their duty of confidentiality and security in the processing of data.

Your rights
All rights remain unaffected according to art. 7 of the statute, whose wording we report at the bottom of the contract.
Art. 7 of Legislative Decree No.196/2003 Right of access to personal data and other rights
- The interested party has the right to obtain confirmation of the existence or lack of personal details concerning the party itself, even if not yet recorded, and the communication of such data in understandable form.
- The interested party has the right to obtain the following information:
- Origin of personal details;
- Purposes and methods of data processing;
- The logic applied in the event of electronic data processing;
- The identity of the data controller, data processors and the representative designated according to Art. 5, section II;
- The subjects or categories of subjects to whom the personal details may be communicated or who can learn about them as appointed representative in the State, managers or agents.
- The interested party has the right to obtain:
- Updates, changes or, when interested, supplements of data;
- Cancellation, transposition into anonymous form or blocking of data processed illegally, including data, which do not need to be kept for the purposes for which the data were collected or subsequently processed;
- Assurance that the operations in headings a) and b) have been related, as far as their contents, to those to whom the data were communicated or circulated, unless this requirement proves impossible or involves a manifestly disproportionate use of resources with regard to the protected right.
- The interested party has the right to object, in whole or in part:
- For legitimate reasons to the processing of personal data, even though they may be pertinent for collection purposes;
- To the processing of personal details concerning the party in question for the purpose of sending advertising materials or direct selling or for carrying out market research or commercial communication.
